Delhi HC asks Election Commission to state facts behind AAP MLAs’ disqualification

The Delhi High Court today asked the Election Commission (EC) to state the factual aspects behind its decision to disqualify the 20 Aam Aadmi Party MLAs for holding the office of profit. The court asked EC to file the affidavit after the poll panel said it wanted to respond to some of the allegations made by the MLAs in their pleas challenging their disqualification.

The Commission told the court that it would rely upon its opinion given to the President to disqualify the MLAs who were appointed as Parliamentary Secretaries.The court listed the matter for further hearing on the 7th of next month by when the MLAs have to file their responses to the EC affidavit.
The court also extended till then the interim order restraining the EC from issuing any notification announcing bye-elections to fill the vacancies of the 20 Assembly seats whose legislators have been disqualified.
